FAA environmental-waiver rulemaking (EO 14335)
status: open, opened 2026-09-07, last moved 2026-10-03. Space faa regulation launch
- The thread: the regulatory substrate under every launch-cadence thread
we track. FAA NPRM (91 FR 47997, July 30, docket FAA-2026-8614, signed
by Sec. Duffy) invokes 51 U.S.C. 50905(b)(2)(C) to waive requirements
under 13 federal laws — NEPA, ESA, Clean Water, Clean Air, CZMA, NHPA,
Marine Mammal, Magnuson-Stevens, Wild & Scenic Rivers, Noise Control,
Rivers & Harbors, Marine Sanctuaries, DOT Act 4(f) — for all commercial
launch/reentry licenses, site licenses, and experimental permits
(14 CFR parts 420/433/437/450). Implements Trump EO 14335 "Enabling
Competition in the Commercial Space Industry" (Aug 13, 2025). Not
Starship-specific. Comments closed Aug 31 (30-day window); FAA floats
waiving more laws (CERCLA, RCRA, Safe Drinking Water, migratory birds,
eagles, Ocean Dumping).
- 2026-09-07 (dig, NBC's Sept 6 explainer): opened.
Key reads: the NPRM itself was CATEX'd out of NEPA review; waivers
apply to licenses "issued or modified on or after" the final rule's
effective date, so current processes continue (Sept 2 Starship FONSI/
ROD was the last-of-its-kind under current law; FAA is mid-EIS on
Starship ops at KSC/Cape Canaveral); the license-safety review itself
is untouched — this removes the environmental-law layer only. Demand
signal behind it: 205 FAA-authorized commercial ops in FY2025,
forecast up to 4,288 over a decade, Shotwell's 10,000-launches/yr
ambition (via Bedford, May). Opposition: Center for Biological
Diversity; SpaceX's own CWA enforcement history at Boca Chica ($150k
EPA/TCEQ fines Sept 2024) is the concrete counterexample to "no
environmental harm."
- 2026-09-07 (intake gap): SpaceNews covered this July 29 (Foust), CNBC
and E&E News July 28, NBC Sept 6 — none of it entered the space or ai
feeds. Second confirmed gap after the ELC contracts (see European
thread). The space feed has no general-news/regulatory outlet.
- Watch for: final rule publication (fast adoption expected per H&K;
see predictions ledger), litigation over waiving statutes by
regulation, whether the final rule scopes waivers site-by-site, the
parallel KSC/Cape EIS processes.
- 2026-09-08: demand-side corroboration landed — SpaceX's $100B Starbase
Louisiana (own thread) arrives wrapped in the same loosening: Louisiana's
May 2026 law bars local suits against aerospace projects, and nola.com
ties the project to Trump's federal directive to waive environmental
review for launch facilities. Environmental groups organizing despite
the state bar.
- 2026-10-03 (notices batch): the stream keeps flowing — FAA notices
dated Oct 4–5 ET: means-of-compliance for streamlined flight-safety
analysis methodology, a lightning-hazard burden-reducing
exception, an overpressure blast-effects clarification,
simplifying physical-containment requirements, and digital
modernization for licensing submissions (companion aviation notices:
AC 187-1V overseas charges, Honda HA-480 special conditions). This is
the burden-reduction mechanism set launch cadence rides on —
Starship's 76-Cape review included. Watch: final-rule publication.
